Terms and Conditions

  1. Participation in this Scheme is voluntary. By choosing to participate in this Scheme, the customer hereby confirms that he/she has studied these detailed terms and conditions and agrees to be bound by the same. Information on how to claim and entitlements shall form part of these Terms and Conditions.
  2. The promotion period (Period): The offer is valid from 17th January 2014 to 15th February 2014 (23:59 hours) the offer is available while stocks last.
  3. The promotion is only valid for customers (resident of India) who have purchased eligible HCL product (Product) (as described below), from any eligible / authorized retailer of HCL in India during the Period.
  4. Procedure to apply / claim for the promotion is as follows:
    • The customer needs to purchase the Product from any authorized HCL dealer /distributor in India.
    • In order to qualify for the promotion, customer must register their Products at the website www.hclstore.in/claim_offer (Promotional Website) by clicking on RICOH LASER PRINTER SP100 portal and complete the “Claim Form” on the Promotional Website by 19th February 2014.
    • The customer shall provide the following details along with other details as specified in the claim form:
      (i) Scanned copy of invoice,
      (ii) Scanned copy of Photo ID proof

      The customer must click “submit / save” only after furnishing true and complete information. HCL is not liable to entertain incomplete, ineligible, erroneous forms.
    • Once the claim has been received and approved, the customer will receive confirmation of receipt of the Claim Form, by email specialpromotions@hcl.com (“Confirmation email”) from HCL stating whether or not the claim for promotion has been successful. It is the customer's responsibility to contact HCL using the email address above within seven (7) days of their claim being sent if an email acknowledgement has not been received.
    • A Ricoh Laser Printer SP 100 (Offered Printer by HCL Offer Partner) will be issued for delivery within 25 days of successful processing of claim by HCL unless there are any unforeseen delays.
    • Delivery of Offered Printer can take up to 7 days from date of despatch. HCL makes no commitment for any timely delivery under the Period.
    • HCL is not liable to entertain any claim made after Rs 3000.
  5. Claims must be submitted by the customer only. Resellers may not submit claims on behalf of their customers.
  6. This offer is not open to employees of HCL, their agents, wholesalers, resellers, retail staff, retailers, participating stockists or anyone (including family members) connected with the promotion.
  7. This promotion offer cannot be granted to the customer who: a) has not purchased an Eligible Product within the Period; and / or b) has not completed the claim form and/or c) has not submitted all documents required for the participation; and/or d) has not submitted their claim by 19th February 2014; and / or and/or e) revoked the purchase contract for the product; and / or f) has failed in any way to comply with these terms and conditions.
  8. HCL reserves the right to audit all requests to ensure that the terms and conditions of the promotion have been met and to request additional information regarding any and all claims and supporting documents. All documentation submitted for this promotion becomes property of HCL and will not be returned. Submission of false, incorrect, misleading or fraudulent documentation may result in disqualification of customer from this promotion and future HCL promotions and may result in the customer being subject to prosecution. HCL decision shall be final and binding in case of any discrepancy.
  9. Personal Information from all claims will be collected and used for the purposes of conducting this offer (which includes disclosure to third parties for the purpose of processing and conducting the offer). By completing and submitting a claim you consent to HCL using your personal information as described and for promotional, marketing and publicity purposes including sending electronic messages.
  10. The customer acknowledges that the Offered Printer provided in the offer is at the sole risk of the customer and that the entire risk as to satisfactory quality, performance, accuracy and effort is with the customer, to the maximum extent permitted by applicable law, the Printer and any service performed or provided by the HCL Offer Partner, are provided “AS IS” and “AS AVAILABLE”, with all faults and without warranty of any kind, and HCL hereby disclaims all warranties and conditions with respect to the Offered Printer and any services, either express, implied or statutory, including, but not limited to, the implied warranties and / or conditions of merchantability of satisfactory quality, of fitness for a particular purpose, of accuracy, of quiet enjoyment, and non-infringement of third party rights. HCL does not warrant against interference with customer’s enjoyment of the offered Printer, that the functions contained in or services performed or provided by, the offered Printer will be uninterrupted or error-free, or that defects in the offered Printer or service will be corrected. No oral or written information or advice given by HCL Offer Partner or its Authorised representative shall create a warranty on behalf of HCL. Should the Offered Printer or services prove defective, customer assumes the entire cost of all necessary servicing, repair or correction. HCL shall in no case be liable for any defect occurring due to use of offered Printer. HCL shall not be liable for any damage or defect in Offered Printer, including any warranties, repair / replacement services etc and the customer shall not hold HCL liable for the same.
  11. The terms and conditions on the Offered Printer shall be applicable on the customer as provided by respective HCL Offer Partner. In case of any contradiction between Terms and conditions of respective HCL Offer Partner and these terms and conditions. HCL’S terms and conditions shall prevail.
  12. Notwithstanding anything to the contrary, HCL’s aggregate liability arising out of or in connection with the contract, whether based on contract, tort, statutory warranty or otherwise, shall be limited to the amount actually paid by the customer for the purchase of the eligible product. HCL shall not be liable for any special, indirect, incidental or consequential damages of any kind including but not limited to loss of use, data, profit, income, business, anticipated savings, reputation, and more generally, any loss of an economic or financial nature, whether these may be deemed as consequential or arising directly and naturally from the incident giving rise to the claim.
    HCL Offer Partner agrees to hold HCL and/or its directors, employees, officers or representatives harmless from any loss (including but not limited to indirect or consequential loss), damage, personal injury, if any, suffered or sustained in connection with their participation in this offer or use of rewards.
  13. HCL is not responsible or liable for any technical, hardware, software, server, website, or other failures or damage of any kind to the extent that this prevents the participant from, or otherwise obstructs him/her in participating in the promotion.
  14. This promotion may not be combined with other promotions, programmes or offers from HCL except where other promotions, programmes or offers provide for this in their terms and conditions. HCL reserves the right to change, discontinue, and extend the promotion and/or the terms and conditions thereof without requiring giving any prior notice. Decision of the HCL with regard to any matter arising out of this promotion shall be final, conclusive and binding and shall not be susceptible to any dispute
  15. HCL shall not be liable for any failure to full fill this offer where such failure is caused by any supervening circumstances amounting to force majeure being an event(s) which, without the fault of either party, render performance impossible or incapable of satisfactory execution.
  16. These terms and conditions do not, nor do they purport to, limit, exclude or modify any non-excludable statutory guarantees as provided under any legislation of India.
  17. In case of any dispute or confusion in interpretation of these Terms and Conditions, HCL’s interpretation shall be final and binding. All disputes related to the offer and/or its interpretation shall be referred to General Counsel, HCL for amicable resolution. Courts at New Delhi shall have exclusive jurisdiction to adjudicate any disputes related this offer.
